Right of access to and re-use of information
Pursuant to Article 3 of the Right to Access Information Act (Official Gazette, Nos. 25/13, 85/15), the right to access information to natural and legal persons is regulated through openness and publicity of public authorities.
The right to access information and reuse information includes the right of users to request and receive information as well as the obligation of public authorities to provide access to requested information, or to publish information regardless of the request when such disclosure arises from an obligation required by law or regulation .
The right to access information and re-use information is regulated and exercised in accordance with the Law on the Right to Access Information (Official Gazette, Nos. 25/13, 85/15). The law prescribes the principles of the right to access information, restrictions on the right to access information and reuse information, the procedure for exercising and protecting the right to access information and reuse information.
Information Officer
Hvarski vodovod d.o.o. Jelsa informs the public through the official website of documents and information in its possession that are publicly available in electronic form and can be accessed without making a special request, and access to all other information and documents is achieved by submitting oral or written.
The right to access information and reuse information is exercised by submitting a request to the information officer of the company Hvarski vodovod d.o.o. Jelsa in the following possible ways:

Conditions for reusing information
- The public authority provides the user with data for unrestricted re-use, for free use and in an open format.
- In justified cases, the public authority may determine the conditions for re-use. In the case of conditions for re-use, their content and application must not unduly restrict the possibility of re-use, nor may they be used to restrict competition.
- The conditions for the re-use of information must not be discriminatory for the same or similar types of information, or for commercial or non-commercial use.
- A public authority that re-uses its information as a basis for commercial activities that do not fall within the scope of its public affairs shall be subject to the same conditions as other users.
- The types and content of permits determining re-uses, in accordance with standard open permits, shall be regulated by the Rulebook of the Minister in charge of administrative affairs.
- The public authority is obliged to publish on its website permits which determine the conditions of re-use or links to such permits in accordance with standard open permits.

Costs of information delivery are calculated according to the valid price list of regular postal services.
Information Access Fee
Hvarski vodovod d.o.o. Jelsa is entitled to reimbursement of actual material costs incurred by providing information to the user of the right to access information and reuse information, as well as reimbursement of costs of delivery of requested information, which is charged in accordance with the Criteria for determining the amount of reimbursement of actual material costs and information costs. : Criterion) pursuant to Article 19, paragraph 2 of the Right to Access Information Act (Official Gazette 25/13, 85/15).
The amount of compensation for actual material costs according to the Criteria for determining the amount of compensation for actual material costs and costs of delivery of information (Official Gazette, No. 12/14) is determined in the following amount:
- copy of one A4 page - 0.03€ (HRK 0.25)
- copy of one page of A3 size - 0.07€ (HRK 0.50)
- Copy of one A4 color page - 0,13€ (HRK 1.00)
- A3 color copy -0.21€ (HRK 1.60)
- electronic record on one CD -0.53€ (HRK 4.00)
- electronic recording on one DVD -0.80€ (HRK 6.00)
- electronic record on the memory card depending on the amount of memory - 27.87€ (HRK 210) for 64 GB, 19.91€(HRK 150)for 32 GB, 15.93€(HRK 120)for 16 GB, 6.64€ (HRK 50) for 8 GB, 3.98€ (HRK 30) for 4 GB.
- converting one page of a document from physical to electronic onlik - 0.11 € (HRK 0.80)
- Convert a recording from a videotape, audio cassette or floppy disk to an electronic recording -0.13€ (HRK 1.00)
Costs of information delivery are calculated according to the valid price list of regular postal services.
NOTE
The amount of compensation for actual material costs for services not specified in the Criteria is determined by the public authority by charging the average market price for the service, the depreciation cost incurred by the public authority and the cost of postal services. The costs of delivering information are calculated according to the valid price list of postal services. The user of the right to information should pay in advance the expected amount of actual material costs in advance. In the event that the user of the right to information does not deposit the specified amount within the deadline, it will be considered that the user of the right to information has waived the request. Hvarski vodovod d.o.o. Jelsa will issue an invoice to the user of the right to information according to the amount of the fee specified in the Criteria.
Information Reuse Fee
Hvarski vodovod d.o.o. Jelsa does not charge a fee for the re-use of information when it publishes information on the official website.
According to the Criteria for determining the amount of compensation for actual material costs and costs of delivery of information on the basis of Art. 19 paragraph 2 of the Right to Access Information Act (Official Gazette 25/13, 85/15), Hvarski voovod d.o.o. Jelsa may charge the user the actual material costs of re-using the information incurred due to the reproduction, provision and delivery of information as well as if one of the following conditions is met:
- A public authority is predominantly financed from its own revenues or
- the user requests information from which the public authority provides adequate revenue to cover the costs of their collection, production, reproduction and publication,
- the public authority determines the re-use fee in accordance with objective, clear and confidential criteria for calculating the costs of re-use of information determined by a decree of the Government of the Republic of Croatia and the costs are calculated in accordance with accounting rules applicable to relevant public authorities,
- The total annual revenue of the public authority generated on the basis of reimbursement does not exceed the costs of collecting, producing, reproducing and providing information, including a reasonable return on investment.
